This Acceptable Use Policy, together with our Platform Services Description, User Terms of Service, Cookie Statement, Privacy Policy, Service Level Agreement, Copyright and Trademark Policy, Security Policy, andBrowser/Mobile Support Policy, form a legally binding agreement between you and us. Capitalised words used but not defined here have meanings provided in the User Terms of Service.
Please carefully read all our terms and policies because they affect your rights and obligations under the law. By using the Platform, you confirm that you understand and agree with this Acceptable Use Policy and our applicable terms and policies. If you do not agree, you may not use the Platform.
We encourage a free and open exchange of ideas in a climate of mutual respect. You must use the Platform for lawful purposes only. You agree to always act appropriately when using the Platform.
Any action by a user that infringes on another user's right to use and enjoy the Platform is prohibited. We reserve the right, but do not assume any obligation, to monitor your online conduct to enforce this policy. We may suspend or terminate Client and User Accounts where we see behaviour, activity, content, or other factors that violate this Acceptable Use Policy, or which would otherwise cause Communic8 Group Pty Ltd any loss and/or damage.
You may not (or attempt to) use the Platform for any of the following:
• violation of all or any legal rights of any person or company or other entity in any jurisdiction;
• sending, accessing, or making available communications or content that contains abusive or objectionable language, that defames or libels others, or that is illegal or obscene;
• sending any form of pornography/sexually explicit content;
• committing crimes;
• in breach of any laws, including laws for the protection of copyright, trade secrets, patents, or other intellectual property; against installation or distribution of "pirated" software or otherwise; and the Privacy Act 1988 (Cth), the EU General Data Protection Law (GDPR) or any other applicable data protection laws.
• exporting software, technical information, encryption software, or technology;
• violation of domestic export control laws;
• introduction of malicious programs into our network, computer, or servers (e.g., viruses, worms, Trojan horses, e-mail bombs);
• actively procuring or transmitting material that is in violation of sexual harassment or workplace relations laws;
• making fraudulent offers of goods or services;
• carrying out security breaches or disruptions of network communication; Security breaches include, but are not limited to, accessing data of which you are not an intended recipient or logging into a server or account that you are not expressly authorized to access, or corrupting any data, network sniffing, pinged floods, packet spoofing, denial of service, and forged routing information for malicious purposes;
• executing any form of network monitoring that will intercept data not intended for you;
• circumventing user authentication or security of any of our hosts, networks, or accounts or those of our customers or suppliers;
• interfering with or denying service to anyone;
• using any program/script/command, or sending messages of any kind, with the intent to interfere with, or disable, any person's use of the Platform;
• sending unsolicited email messages through or to users of the Platform in breach of spam laws that apply to your messages, including the Spam Act 2003 (Cth);
• creating or forwarding "chain letters", "Ponzi" or other "pyramid" schemes of any type; and
• hosting images or content for any purpose other than for the sending of communications.
We maintain a high deliverability rate for all communications sent from the Platform. This is largely due to our reputation and adherence to best practices when constructing and sending communications. In line with this approach, we do have to limit certain industries from using our Platform for their communication needs due to the likelihood of abuse complaints, which can severely impact our delivery rates for everyone using the platform. We do not allow businesses that offer the following types of services, products, or content from using our platform:
• Cryptocurrency sales, marketing, transactions, exchange, storage, or the production of virtual currencies and any kinds of digital assets related to Initial Coin Offering (ICOs);
• Gambling services, products, or schemes;
• Multi-level or affiliate marketing;
• Pharmaceutical product offers and discounts;
• Online dating or escort services;
• Lead generation opportunities;
• Work-from-home opportunities or make money online offers;
• Get out of debt opportunities, urgent cash offers, and credit repair;
• Pay lending offers;
• List rental services and list brokers; and
• Selling social media “Likes” or followers.
